These Terms of Service (“Terms”) are a binding agreement between you and xcircl LLC, a Delaware limited liability company (“xcircl,” “we,” “our,” or “us”), governing your use of the xcircl website at xcircl.com, the landing site at app.xcircl.com, and the xcircl mobile application (collectively, the “Service”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
Arbitration and class-action waiver notice: Section 12 contains a binding arbitration clause and class-action waiver that, to the extent permitted by law, affect your rights to resolve disputes with xcircl. Please read it carefully.
1. What the Service is
xcircl is a U.S. directory and comparison platform for pet services — pet boarding, training, grooming, daycare, and veterinary care. The xcircl iPhone app provides household-level pet care tools (tasks, care logs, pet profiles, caregiver coordination).
xcircl is an information platform. xcircl does not operate pet businesses, does not provide veterinary, medical, or professional advice, and does not process booking transactions on your behalf. All bookings and care decisions are between you and the provider.
2. Eligibility and accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or submit information. You agree to provide accurate information, to keep your login credentials secure, and not to share your account. You are responsible for activity under your account.
3. Directory content and listings
Listing information on the website is aggregated from publicly accessible business listings, owner-submitted corrections, and editorial review. xcircl does not guarantee that every listing is complete, current, or appropriate for your pet. You should independently verify pricing, availability, credentials, vaccine requirements, care policies, and any other details directly with each provider before booking.
Trust scores, summaries, tags, and comparison notes are editorial signals for browsing only. They are not endorsements, certifications, or guarantees of quality. The methodology behind trust scores is proprietary and may change without notice.
If you are a business owner and want a listing corrected, updated, or removed, use the claim flow or email support@xcircl.com with the subject line “Listing Update Request.”
4. Acceptable use
- Do not misuse, scrape at scale, overload, probe, or attempt unauthorized access to the Service.
- Do not submit false claims, impersonate another person or business, or knowingly provide misleading information.
- Do not copy, republish, sell, or sublicense directory content in a way that infringes rights or violates law.
- Do not use the Service to send spam, harass other users, or transmit unlawful, infringing, or harmful content.
- Do not reverse engineer, decompile, or attempt to extract source code from the Service.
5. User submissions
If you submit a claim request, consumer inquiry (lead form), feedback, listing edit, or other content, you represent that the information is accurate to the best of your knowledge, that you have the right to submit it, and that it does not violate any third-party right or law. You grant xcircl a worldwide, royalty-free license to store, display, and use your submissions to operate and improve the Service (including forwarding lead inquiries to the relevant business owner).
6. Subscriptions, billing, and cancellation
Business owners can purchase recurring paid plans on the website:
- Featured — US$49 per month.
- Premium — US$299 per month.
Auto-renewal. Paid plans automatically renew every month at the then-current price, charged to the payment method on file through Stripe. Your plan continues until you cancel.
How to cancel. Sign in, go to Account → Manage Subscription, and follow the link to the Stripe customer portal to cancel. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then. You may also email support@xcircl.com to request cancellation assistance.
Refunds. Because paid plans are billed month-to-month, fees already charged are not refundable, including for partial months, unused time, or listings that are later unpublished. We may, at our sole discretion, issue a refund in cases of billing error or documented service failure.
Price changes. We may change subscription prices from time to time. Material price changes will be announced by email at least 30 days before they take effect. If you do not agree to a new price, cancel before the effective date to avoid the new charge.
Failed payments. If a charge fails, we may retry collection, temporarily downgrade the listing to the free tier, and eventually cancel the subscription. You remain responsible for unpaid fees.
Mobile App Pro subscription. The xcircl iPhone app offers an optional App Pro subscription (currently US$4.99/month) sold and billed through the Apple App Store. Purchases, renewals, refunds, and cancellations for App Pro are handled by Apple under the Apple Media Services Terms, not by xcircl. Manage or cancel App Pro in iPhone Settings → Your Apple ID → Subscriptions.
7. Account and data deletion
You may delete your account at any time. In the iPhone app: Me → Account → Delete Account. For the website, email support@xcircl.com with the subject “Delete My Account.” Account deletion removes your personal profile and household data; some records (for example, invoices) may be retained for tax and legal obligations as described in the Privacy Policy.
8. Intellectual property
All content on the Service — including software, text, graphics, logos, trademarks, the xcircl wordmark, editorial summaries, and trust-score methodology — is the property of xcircl or its licensors and is protected by applicable intellectual-property laws. You may not reproduce, distribute, modify, or create derivative works from Service content without our prior written permission, except for fair use or as otherwise permitted by law.
9. DMCA — copyright complaints
If you believe content on the Service infringes your copyright, send a notice to support@xcircl.com with the subject line “DMCA” containing: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material with a URL; (c) your contact information; (d) a statement of good-faith belief that the use is not authorized; (e) a statement that the information is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner; and (f) your physical or electronic signature. Misrepresentation may subject you to liability.
10. No warranties
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, xcircl disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted availability. xcircl does not warrant the quality, safety, or legality of any pet business listed on the Service.
11. Limitation of liability
To the fullest extent permitted by law, xcircl, xcircl LLC, and their officers, members, employees, contractors, and affiliates shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or procurement of substitute goods or services, arising from or related to the Service, even if advised of the possibility. xcircl’s total aggregate liability for all claims arising from or related to the Service will not exceed the greater of (a) the amounts you paid to xcircl in the 12 months immediately preceding the event giving rise to the claim, or (b) US$100. Some jurisdictions do not allow these limitations; in those jurisdictions, the limitations apply to the fullest extent permitted.
xcircl is not responsible for disputes, transactions, injuries, property damage, veterinary emergencies, or losses arising from your use of, or reliance on, a listed business. Always evaluate any provider directly before making care decisions.
12. Governing law, arbitration, and class-action waiver
Governing law. These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles.
Informal resolution first. If you have a dispute with xcircl, contact us at support@xcircl.com and we will try to resolve it informally within 60 days.
Binding arbitration. If we cannot resolve the dispute informally, you and xcircl agree that any dispute arising out of or relating to these Terms or the Service will be resolved through final, binding arbitration on an individual basis, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Wilmington, Delaware or another mutually agreed location, or by videoconference. The arbitrator’s decision is final and may be entered as a judgment in any court of competent jurisdiction.
Class-action waiver. To the extent permitted by law, you and xcircl each waive any right to participate in a class action, collective action, representative action, private attorney general action, or consolidated arbitration against the other.
Opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@xcircl.com with the subject “Arbitration Opt-Out” and your account email.
Small claims. Either party may bring an individual action in small-claims court in a jurisdiction where the party resides.
13. Termination
We may suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms, non-payment, or actual or suspected abuse. You may stop using the Service or delete your account at any time. Sections 5 (license you grant us), 8–12 (IP, warranties, liability, arbitration), and 14 (general) survive termination.
14. General
Changes. We may update these Terms from time to time. Material changes will be announced by updating the “Last updated” date and, where appropriate, by email or in-app notice. Continued use of the Service after the effective date means you accept the updated Terms.
Force majeure. xcircl is not liable for delays or failures in performance due to causes beyond its reasonable control (natural disasters, outages of third-party services such as Stripe or Firebase, cyber incidents, government actions, labor disputes, internet or power failures).
Entire agreement. These Terms, together with the Privacy Policy and any additional terms referenced herein, are the entire agreement between you and xcircl regarding the Service and supersede any prior agreements.
Severability. If any provision is held invalid, the remaining provisions remain in effect. No waiver of any term is effective unless in writing.
Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
